1. ABOUT US

 

1.1  Your purchase of goods from www.masterpiececollectibles.com (“website”) is subject to these Terms and Conditions of Sale, the Terms of Use, the Returns Policy, the Cookies and Privacy Statement and any Catalogue Terms (collectively referred to herein as “Terms”). If you do not accept these Terms, you must refrain from using this website or making a purchase from this website.

 

1.2  www.masterpiececollectibles is a website operated by Masterpiece Collectibles (“us”, “our”, “we”, “Masterpiece Collectibles”, “the company”). We are registered in Singapore (UEN 53168578X) and have our registered office at Blk 462 Crawford Lane, #02-47, Singapore 190462

 

1.3  You and Masterpiece Collectibles may enter into a sale contract for the sale and supply of goods or services described in this website, by you making an offer to Masterpiece Collectibles via the website, to purchase the goods and services at the specified price, subject to these Terms.

 

In these Terms:

• “you”, “user”, “member”, and “guest” means anyone who visits and/or uses this website

• reference to a “third party” in these Terms includes a reference to any agent or contractor of Masterpiece Collectibles, or of any of its related entities, and any person engaged by any of them, in the creation, provision or maintenance of the website or in the fulfilment of Orders made through the website, and includes any of them

• a reference to the "website" means www.masterpiececollectibles.com.

 

1.4  The Masterpiece Collectibles logo and words, and all its other associated logos (MC64, Masterpiece Collectibles City, Yesteryear Series, Boss Edition) are registered trademarks of Masterpiece Collectibles and may not be reproduced without permission from the company.

 

1.5  All content and materials available on the website, including but not limited to text, graphics, website name, code, images and logos are the intellectual property of Masterpiece Collectibles, and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited, unless specifically authorized by the company.

 

 

2. USER AGREEMENT

 

2.1  This agreement is in effect as of Jun 14, 2013.

 

2.2  We reserve the right to change this user agreement from time to time without notice. You acknowledge and agree that it is your responsibility to review this user agreement periodically to familiarize yourself with any modifications.

 

2.3  Your continued use of this site after such modifications will constitute acknowledgement and agreement of the modified terms and conditions.

3. RESPONSIBLE USE AND CONDUCT

 

3.1  By visiting our website and accessing the information, resources, services, products, and tools we provide for you, you agree to use these resources only for the purposes intended as permitted by
(1) the terms of this user agreement, and

(2) all applicable laws, regulations and generally accepted online practices or guidelines

 

3.2  You may access and/or use the website as a guest or as a member.

 

3.3  To become a member of the website, you must provide your name and address, telephone number, a valid email address and nominate a password. If you do not provide accurate and complete details, we may not be able to activate your membership or supply goods or services to you. You agree to keep your membership details current at all times by accessing your account via the website

 

3.4  You are responsible for maintaining the confidentiality of any login information associated with any account you use to access our resources. Accordingly, you are responsible for all activities that occur under your account(s).

 

3.5  Accessing (or attempting to access) any of our resources by any means other than through the means we provide, is strictly prohibited. You specifically agree not to access (or attempt to access) any of our resources through any automated, unethical or unconventional means.

 

3.6  It is prohibited to engage in any activity that disrupts or interferes with our resources, including the servers and/or networks to which our resources are located or connected

 

3.7  Attempting to copy, duplicate, reproduce, sell, trade, or resell our resources is strictly prohibited

 

3.8  You must not use another member’s account without permission.

 

3.9  You must keep your password secure as you are responsible for any activity on your account. You agree to notify us immediately if you become aware of any security breach or any unauthorised use of your password or account.

 

3.10  We reserve the right to terminate a member’s account without notice for any reason whatsoever including without limitation, if you have breached or we suspect you have breached these Terms.

 

3.11 You are solely responsible for any consequences, losses, or damages that we may directly or indirectly incur or suffer due to any unauthorized activities conducted by you, as explained above, and may incur criminal or civil liability.

4. ORDERS

 

4.1  We recommend you carefully preview any proposed Orders before adding them to your shopping cart and proceeding with your Order.

 

4.2  Once an Order has been accepted by Masterpiece Collectibles, no cancellation or modification of that Order is valid unless you receive our written communication permitting the cancelled Order

 

4.3  You and Masterpiece Collectibles may enter into a contract for the sale and supply of goods or services by you making an offer via the website to purchase goods at the price advertised on the website by:

   4.3.1 Placing an electronic Order for the goods or services using the website.

   4.3.2 You confirm the Order details in accordance with the procedure on the website.

   4.3.3 You making payment in full (plus any applicable delivery and handling charges) on the website.

   4.3.4 The acceptance of that offer by Masterpiece Collectibles

 

4.4 When entering into a sale contract via the website, you will be taken to have communicated your offer to purchase the good(s) or services only when:

(1) any and all requirements set out in these Terms have been met.

(2) the electronic instruction containing the offer from you enters and is recorded in our database

(3) a record is created and stored in our database

(4) Masterpiece Collectibles receives in its account full payment from you for the goods or services (including any applicable delivery and handling charges) and confirmation of that payment is received by our database.

5. PRICE

 

5.1  Prices shown are in Singapore dollars and include GST where applicable.

 

5.2  Prices may not include delivery and handling charges.

 

5.3  Prices are valid until amended or removed from the website and are subject to change at any time.

6. SUPPLY AND DELIVERY

​

6.1  Subject to you complying with these Terms and acceptance of your Order by Masterpiece Collectibles, we will sell and supply the goods or services to you as shown on your Order confirmation.

 

6.2  If the goods that you have ordered are in stock, we will endeavour to dispatch orders within fourteen working days.

 

6.3  Goods may not be available for immediate delivery

 

6.4  Delivery dates are estimates only and we are unable to accept any liability for failure to deliver the goods within the specified time resulting from shipment/delivery delays from our suppliers.

 

6.5  If there is no one available to accept delivery on the pre-arranged delivery date, you will be charged for storage, transport and re-delivery costs

6.6  Should you arrange your own delivery or collection then the goods become your responsibility upon collection from Masterpiece Collectibles

​

6.7  We cannot accept responsibility for delivery failures or delays by our third party delivery contractor.

 

 

7. PREORDERS

​

7.1  Subject to you complying with these Terms and acceptance of your Order for Preorder Items by Masterpiece Collectibles, we will sell and supply the goods or services to you as shown on your Order confirmation

 

7.2  Payment must be made in full for us to accept your Preorder

 

7.3  Delivery dates are estimates only and we are unable to accept any liability for failure to deliver the goods within the specified time resulting from shipment/delivery delays from our suppliers

 

7.4  We reserve the right to cancel the preorder should our supplier fail to deliver the goods, or for any circumstances deemed fit by us. In such an instance, Masterpiece Collectibles will issue a full refund to you.

 

7.5  We cannot accept responsibility for failures to deliver due to such cancellations.

8. DELIVERY BY POST OR COURIER

​

8.1  The terms of this clause apply where you select to have your goods delivered to a specified address

 

8.2  We reserve the right to choose as we deem fit, a suitable delivery agent to deliver your goods.

   8.2.1  For local deliveries, we may use (but not limited to) Singapore Post, Lalamove

   8.2.2  For overseas deliveries, we may use (but not limited to) Singapore Post, DHL, SF Express

 

8.3  Should you prefer a certain mode of delivery by a preferred agent, you will be responsible for any additional shipping costs incurred

 

8.4  Local delivery address must be an address within Singapore and cannot be a freight forwarding location. Deliveries cannot be made to PO Boxes and the following areas: Jurong Island, Army Camps, Off-shore Islands such as Pulau Ubin, Shipyards and other restricted areas.

 

8.5  Overseas delivery addresses must be clearly stated. It is your responsibility to ensure the accuracy of your details. We currently do not ship to Africa, South America, the Middle East, Eastern Europe and Russia.

   8.5.1. You will be responsible for all additional import taxes

 

8.6  Masterpiece Collectibles cannot and will not accept responsibility for delivery failures or delays by our third-party delivery contractor.

8.7  By selecting delivery by post or courier, you accept that your goods may sustain damage during transit. While we strive to pack your orders as careful as possible, we will not accept responsibility for any damage to your goods sustained in transit provided by our delivery vendors.

 

8.8  We adopt a strict NO RETURN, NO REFUND, NO EXCHANGE policy for orders sent through post or courier. We will not provide any exchange or replacement models for any damaged goods received through post or courier.

 

8.9  You are required to inspect your goods when you take delivery of them. In case of wrong order, you will be required to notify us in writing within seven (7) days of delivery. We will not be liable for any errors to orders unless we are notified within the time period specified above.

 

8.10  In case of damaged goods, you may send / bring the model back to our company at your own expense where we will try to offer basic repair work depending on availability of parts. There is no guarantee of repair. We will suggest alternatives where ever possible.

 

 

9. CANCELLATION OF ORDERS

9.1  You have the right to cancel your Order on the condition that
   (1) your order has not been accepted by the company
   (2) your order has not been shipped out
   (3) your order is not a preorder item

10. ORDER ENQUIRIES

​

10.1  If you have any query about the progress of your Order please contact our Customer Service Team. Please have your Order number handy as shown on the email confirmation of your Order.

11. LIMITATION OF WARRANTIES

​

11.1  By using our website, you understand and agree that all resources we provide are "as is" and "as available". this means that we do not represent or warrant to you that:
   (1) The use of our resources will meet your needs or requirements.
   (2) The use of our resources will be uninterrupted, timely, secure or free from errors.
   (3) The information obtained by using our resources will be accurate or reliable, and
   (4) Any defects in the operation or functionality of any resources we provide will be repaired or corrected.

Furthermore, you understand and agree that:

   (5) Any content downloaded or otherwise obtained through the use of our resources is done at your own discretion and risk, and that you are solely responsible for any damage to your computer or other devices for any loss of data that may result from the download of such content.
   (6) no information or advice, whether expressed, implied, oral or written, obtained by you from our website or through any resources we provide shall create any warranty, guarantee, or conditions of any kind, except for those expressly outlined in this user agreement.

12. LIMITATION OF LIABILITY

​

12.1  In conjunction with the limitation of warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services.

 

12.2  Masterpiece Collectibles will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our resources, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.

13. PAYMENT AND CREDIT CARD FRAUD

​

13.1  To the fullest extent permitted by law, Masterpiece Collectibles and its related entities will not be responsible for any damages or consequential losses of any kind (whether direct or indirect) suffered by a user where a credit/debit card, PayPal account or other payment method is fraudulently used or is used in an unauthorised or improper manner.

14. FORCE MAJEURE

​

14.1  Masterpiece Collectibles will not be liable for any delay in performing any of their obligations if such delay is caused by circumstances beyond their reasonable control, including but not limited to natural disasters, act of war, riots, transport accidents, failure of or interruption in the provision of essential services such as electricity supply, bank payment systems or postal deliveries

15. GOVERNING LAW

​

15.1  The courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our website or any Order placed on the website, although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These Terms are governed by Singapore law.

16. PERSONAL DATA PROTECTION ACT

​

16.1  Your data such as (including but not limited to) Name, Contact Number, Email Address, Delivery Address will be stored to assist in completing your order. Your payment details will not be stored on our server.

​

16.2  Your data will not be used for any other purposes (including but not limited to) such as marketing except for the sole purpose of completing your order.

​

16.3  All our practices are done with close adherence to the Personal Data Protection Act by the Government of Singapore.

16.  SEVERABILITY

​

16.1 If any part of these terms are found to be void, invalid, unlawful or unenforceable then that provision or part will be deemed to be severed from these terms and the remaining terms and provisions of these terms will remain in force and constitute the agreement between you and Masterpiece Collectibles.
